Terms of Use

These terms of use, referred to as the “TOU”, are intended to provide the legal framework for the terms under which the services, website https://www.papatte.app, and Papatte mobile application (the “Service”) are made available by Softeos, and to define the conditions of access to and use of the services by the “User”.

These TOU are available on the Service under the “TOU” section.

Any registration for or use of the Service implies the User’s acceptance of these TOU without reservation or restriction. When registering for the Service via the registration form, each User expressly accepts these TOU: “By continuing, you confirm that you have read and understood our Terms of Use.”

Softeos reserves the right to unilaterally amend the content of these TOU at any time.

Article 1: Legal Notice

The website https://www.papatte.app and the Papatte mobile application are published by Julien Bajon, sole proprietor operating under the trade name Softeos, registered under SIREN number 884 099 946, whose business address is located at: 26 bis avenue des Bourdies, 31880 La Salevetat Saint Gilles, France.

The host of the website https://www.papatte.app is Vercel Inc., a company governed by U.S. law, whose registered office is located at 440 N Barranca Ave #4133, Covina, CA 91723, United States.

Article 2: Access to the Service

The Service provides the User with free access to the following services:

A SaaS animal health record application intended for private users (B2C).

The Service is accessible free of charge from anywhere to any User with Internet access. All costs incurred by the User to access the Service, including computer hardware, software, Internet connection, and similar costs, are borne by the User.

Any event caused by force majeure resulting in a malfunction of the Service, and subject to any interruption or modification in the event of maintenance, shall not give rise to liability on the part of Softeos. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of the Service, even without notice.

The User may contact Softeos by email at the publisher’s email address provided in Article 1.

Article 3: Data Collection

The terms governing the processing of personal data are described in the Privacy Policy, available on the Service.

Article 4: Intellectual Property

The trademarks, logos, signs, and all content of the Service, including texts, images, sounds, and other materials, are protected by the French Intellectual Property Code, and more specifically by copyright law.

The User must obtain prior authorization from Softeos for any reproduction, publication, or copying of the various content. The User undertakes to use the content of the Service strictly for private purposes; any use for commercial or advertising purposes is strictly prohibited.

Any total or partial representation of the Service by any means whatsoever, without the express authorization of the Service operator, would constitute infringement punishable under Article L.335 and following articles of the French Intellectual Property Code.

In accordance with Article L.122-5 of the French Intellectual Property Code, the User is reminded that any User who reproduces, copies, or publishes protected content must cite the author and source.

Article 5: Liability

The sources of the information published on the Service are deemed reliable, but Softeos does not guarantee that the Service is free from defects, errors, or omissions.

The information provided is presented for general informational purposes only and has no contractual value. Despite regular updates, Softeos cannot be held liable for changes in administrative and legal provisions occurring after publication. Likewise, Softeos cannot be held liable for the use or interpretation of the information contained on this Service.

The Service cannot be held responsible for any viruses that may infect the Internet user’s computer or any computer equipment following use of, access to, or downloading from this Service.

The Service’s liability cannot be incurred in the event of force majeure or due to the unforeseeable and unavoidable act of a third party.

Article 6: Protection of Minors

The Service is intended for adults and persons aged 18 or over. Any use of the Service by minors is strictly prohibited.

Article 7: Hyperlinks

Hyperlinks may be present on the Service. The User is informed that by clicking on these links, they will leave the Service. The Service has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

Article 8: Cookies

The Service may use cookies or similar technologies under the conditions described in the Privacy Policy.

Article 9: Applicable Law and Jurisdiction

French law applies to this agreement. In the absence of an amicable resolution of a dispute arising between the parties, the French courts shall have sole jurisdiction.

Article 10: Terms and Conditions of Sale

The paid services offered by Softeos are governed by Terms and Conditions of Sale, referred to as the “TCS”, which are accessible at any time on the Service under the “TCS” section or at the following address: https://www.papatte.app/cgv.

The TCS define, in particular, the conditions for subscription, billing, payment, renewal, termination, and the User’s financial obligations.

The TCS form an integral part of this agreement. By accepting these Terms of Use, the User acknowledges having read the TCS and accepting them without reservation.

In the event of any contradiction between the TOU and the TCS, the TCS shall prevail with respect to provisions relating to paid services.
