Terms and Conditions of Sale

SaaS animal health record application
1. Purpose and Scope
These Terms and Conditions of Sale, hereinafter referred to as the “Terms of Sale”, are intended to define the conditions under which Softeos, hereinafter referred to as the “Provider”, makes available to its individual customers, hereinafter referred to as the “Customer”, a mobile animal health record application, Papatte, accessible in SaaS mode, hereinafter referred to as the “Service”.
The Terms of Sale apply exclusively to individual customers within the meaning of French law.
Any use of the Service implies full and unconditional acceptance of these Terms of Sale.
2. Description of the Service
The Service allows the Customer to:
- create, modify, or delete health tracking records for their pets,
- create, modify, or delete reminders for their pets,
- add, modify, or delete their pets from the Service,
- store documents related to health tracking records and reminders locally.
3. Access to the Service and Account Creation
Access to the Service does not require the creation of an account.
4. Management of Data Entered in the Service
The Provider does not intervene in any way with respect to the data entered in the Service.
Furthermore, the data entered is stored locally on the Customer’s device and is not accessible by the Provider.
5. Financial Terms
5.1 Freemium Model
The Service is offered under a freemium model, with free features and paid features accessible through a subscription.
5.2 Subscription and Billing
The Service is offered under two subscription plans:
- €4.99 excluding VAT per month, with no commitment;
- €39.99 excluding VAT per year, with no commitment.
Billing begins after a free 14-day trial period following subscription, and is then automatically renewed on the anniversary date, unless terminated by the Customer before that date.
Deleting the application does not automatically terminate the subscription.
5.3 Payment
Payment is made through Apple’s App Store or Google Play, depending on the platform used by the Customer.
The Customer accepts the terms and conditions of the relevant platform.
Any failure to pay authorizes the Provider to suspend access to the Service without prior notice.
5.4 Disputes
Payment, billing, renewal, cancellation, and, where applicable, refund requests are subject to the applicable terms of the App Store or Google Play.
6. Intellectual Property
The Provider remains the owner of all intellectual property rights relating to the Service, the software, the interface, and the documentation.
The data entered by the Customer remains the property of the Customer.
No transfer of rights is granted under these Terms of Sale.
7. Personal Data
In connection with the use of the Service, the Provider does not have access to the data entered by the Customer.
8. Suspension and Termination
The Provider reserves the right to suspend or terminate access to the Service in the event of:
- non-payment,
- abusive or fraudulent use,
- violation of these Terms of Sale.
9. Changes to the Service and Terms of Sale
The Provider reserves the right to make changes to the Service and to these Terms of Sale.
The new Terms of Sale shall apply after notification to the Customer.
10. Applicable Law and Competent Jurisdiction
These Terms of Sale are governed by French law.
Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the courts within the jurisdiction of the Provider’s registered office.
